FOUNDER, PRINCIPAL ATTORNEY

Edward C. Greenberg

Ed Greenberg has been a litigator, lecturer, author, civil court mediator and expert witness on matters concerning intellectual property and model's rights for over 38 years.  He litigates regularly in the Federal and State Courts having appeared as counsel in well over one thousand cases. 

Ed actually goes to court and tries real cases in front of actual judges and juries. He has appeared before the trial courts of several states, has argued appellate cases at the State and Federal levels, and has served as an expert witness retained by other attorneys in photo related matters.

These cases include: copyright infringement actions, violations of rights of publicity/privacy, photographer/agent disputes, photographer/ad agency disputes, disputes regarding the use of a model's images in violation of state or Federal law, and matters involving model agencies.  He has tried several cases involving the failure of stock agencies to return imagery and/or pay sums due contributors.

He has been on the faculty and now lectures regularly at The School of Visual Arts in New York, has lectured at a dozen Photoshop World conferences, has represented the American Photographic Artists (APA), Editorial Photographers  of America (EP) and the Society of Illustrators.  Along the way he has authored or co-authored numerous publications and appears in countless videos and webinars often with famed photographer Jack Reznicki (Former President of PPA). Mr. Greenberg has also co-authored proposed legislation for the US Congress with Prof. Nimmer and others.  His most recent book "The Copyright Zone" authored with Mr. Reznicki, is currently in use as a text book or required reading at several colleges and universities.

Tamara L. Fitzgerald

Hailing from America's west coast, and having lived in California, Oregon and Las Vegas, Ms. Fitzgerald is well acquainted with business practices and lifestyles from a variety of environments.  Her world view has been further enhanced by her having studied in both Boston and London.  She now calls New York home. 

Ms. Fitzgerald has been with the firm, litigating and practicing intellectual property law since 2010.  Prior to becoming the firm's premier associate, she worked in both the programming and business and legal department of a major cable television network.  

During her tenure at Edward C. Greenberg, LLC, she has drafted scores of agreements, and served as an effective negotiator and litigator.   Ms. Fitzgerald routinely briefs and argues motions, appears at court conferences, and negotiates settlements for cases.  She has conducted numerous pre-trial depositions of witnesses, conducted settlement conferences in both the NY State and Federal Courts, and fully participated in trials, including examining witnesses, selecting juries, and arguing motions.

She possesses superior research and computer skills which assist the office is tracking and tracing the unauthorized use of the images of models, celebrities and lay people on the web and in other venues.  Those same skills are employed in tracking copyright infringements of our clients who are photographers, artists and illustrators.

Ms. Fitzgerald has effectively participated in scores of proceedings in the Federal Courts including conferences, motions and settlement or mediation conferences conducted by United States District Court Judges and Magistrate Judges in copyright, Lanham Act and privacy/publicity cases.

She is fully familiar with each facet of every intellectual property case in which the office is engaged.  Fortunately and unlike Mr. Greenberg, Ms. Fitzgerald does not possess a "New York accent" and is blessed with a world of patience.
